Settlement of Imbalances and the Short-Term Market
Agreement on Settlement of Imbalances - Electricity
1. Requirements
The basic requirements for opening negotiating the Agreement on Settlement of Imbalances (the "Agreement") for a market participant who will become responsible for his imbalance (the "Subject of Settlement") are as follows:
- registered company or branch in the Commercial register Czech Rep.;
- valid license for the Electricity Market issued by Energy Regulatory Office;
- bank account (in CZK) in a Czech bank or a branch of an international bank in the Czech Republic (for settlement of the Day-ahead Market in EUR use only Komerční banka, a.s.).
2. Documents required for the Agreement execution
For the Agreement or for the Agreement on Access to the Organized Short-Term Electricity Market completion, which provides access to the Organized Short-Term Electricity Market, the applicant sends via email registrace@ote-cr.cz the following documents:
- Registration Form "B“ – the market participant obtains a registration number ("ID RMP") and becomes a Registered Market Participant (the "RMP"). If the market participant is already registered, he will keep his ID RMP.
The registration fee invoice will be printed after receipt of the signed Form "B" via email or post.
- Registration Form "C", on behalf of each person who will have access to Central System OTE ("CS OTE").
- Names and roles of personnel authorized to sign agreements.
- The table of personnel authorized to communicate with OTE.
- An e-mail address for sending the Agreement ready for sign off in PDF format.
- Details of financial security - link to the Risk Management.
(While the registration and Agreement are being prepared financial security is secured in "Appendix No. 2 to the Agreement" according to conditions and scope of business. Mutually agreed Appendix No.2 becomes an inseparable signed part of the Agreement.)
3. Invoice
OTE will print an invoice for the registration fee of 10,000 CZK and send it to the requested address, or hand over by arrangement.
4. Individual registration
OTE will assign a user identification number ("UID") to participants authorized personnel, who will have access to CS OTE. Information based on Registration Form "C" will be sent to the applicant.
5. Access to CS OTE
The applicant can obtain secure access to OTE’s CS upon the following:
- paying the invoice for registration (Fee 10,000 CZK),
- acquiring UID.
Secure items can be obtained either via an internal certification authority OTECA or external certification authorities. Detailed information reference on the link: Access to CS OTE.
On request access will be given to the test environment of CS OTE - Sandbox upon payment of the registration fee 10,000 CZK.
6. Agreement
After crediting the 10,000 CZK to OTE’s account - OTE will prepare an original copy of the Agreement and send in PDF format to the e-mail address specified in Part 2.
7. Activation in CS OTE
a) A new Subject of Settlement will return to OTE the signed Agreement in paper form (2 copies), and handover the following documents:
- originals of signed Registration Forms "B" and "C";
- a certified copy of extract from the Commercial Register;
- a certified copy of the appropriate license;
- established direct debit for the benefit of OTE’s accounts (specified in the Agreement) - confirmed by the bank;
- proof of registration for VAT in the Czech Republic or Europe if the applicant has not an Office in the Czech Rep. (under the Act no. 235/2004 Coll. §4);
- proof of acquisition of electricity excluding tax (recommended). Permit is issued by Celni sprava.
b) Activation in CS OTE upon the following:
- secured financial security;
- established direct debit for the benefit of OTE’s accounts (specified in the Agreement);
- receipt public part of the certificate for security access to CS OTE.
c) The agreement takes effect on the day of signature and is effective after meeting the financial security conditions (financial security, direct debit in OTE's favor).
d) A new Subject of Settlement will be activated in CS OTE at the latest on the 1st day of the following month after the Agreement has taken effect.
